Welcome to Kavrah Scents. These Terms of Service ("Terms") govern your access to and use of the Kavrah Scents website (kavrah.co.za) and the purchase of products from our online store. By accessing our website, creating an account, or placing an order, you agree to be bound by these Terms.

Please read them carefully. If you do not agree with any part of these Terms, please do not use our website or place an order.

This agreement is governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, and the Protection of Personal Information Act 4 of 2013.

In these Terms, "we", "us", and "our" refer to Kavrah Scents. "You" and "your" refer to the customer or user of our website.

2. Eligibility

By using our website or placing an order, you confirm that:

You are at least 18 years of age or have the consent of a parent or legal guardian
You have the legal capacity to enter into a binding contract under South African law
The information you provide to us is accurate, current, and complete
Your use of the website complies with all applicable laws and these Terms

We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion, including where we have reason to believe the above conditions have not been met.

3. Your Account

3.1 Creating an Account

You may create an account on our website to make ordering, tracking, and managing your purchases easier. When creating an account, you agree to:

Keep your login credentials confidential
Notify us immediately of any unauthorised access to your account
Accept responsibility for all activity that occurs under your account

3.2 Account Security

You are responsible for maintaining the security of your account. Kavrah Scents is not liable for any loss or damage arising from your failure to keep your login details secure.

3.3 Account Termination

We reserve the right to suspend or terminate your account at our discretion, including in cases of:

Breach of these Terms
Fraudulent, abusive, or illegal activity
Repeated chargebacks or payment disputes without justification
Behaviour that is harmful to our business, staff, or other customers

4. Products and Pricing

4.1 Product Information

We make every effort to display our products and their descriptions accurately. However, the appearance of products may vary slightly depending on your screen settings, and fragrance experiences are inherently subjective.

All product information, including descriptions, scent profiles, longevity claims, and inspirations, is provided for informational purposes. While we describe our fragrances as faithfully as possible, individual experiences may vary based on skin chemistry, climate, and application.

4.2 Pricing

All prices on our website are displayed in South African Rand (ZAR) and include Value Added Tax (VAT) where applicable.

We reserve the right to change prices at any time without prior notice. The price applicable to your order is the price displayed at the time you place the order, regardless of subsequent changes.

4.3 Pricing Errors

In the event of an obvious pricing error on our website (such as a fragrance listed at R10 instead of R349), we reserve the right to cancel the order and refund any payment made, even if the order has already been confirmed. We will notify you promptly if this occurs.

4.4 Stock Availability

All orders are subject to stock availability. While we make every effort to keep stock levels accurate, errors can occur. If a product is unavailable after your order has been placed, we will notify you and offer a refund, exchange, or backorder option.

4.5 Promotional Offers and Discounts

Promotional offers, discount codes, and sales are subject to specific terms which will be communicated at the time of the offer. We reserve the right to:

Limit the use of discount codes to one per order or per customer
Exclude certain products from promotional pricing
Withdraw or modify offers at any time
Cancel orders where promotional codes have been used fraudulently or in breach of their terms

5. Orders and Payment

5.1 Placing an Order

When you place an order through our website, you are making an offer to purchase the selected products. Your order is only accepted once we send you an order confirmation email. Until that point, we are not obligated to fulfil the order.

5.2 Order Acceptance

We reserve the right to refuse or cancel any order at our discretion, including but not limited to:

Suspected fraudulent activity
Unverified or invalid payment details
Errors in product descriptions or pricing
Stock unavailability
Delivery to a location we cannot reliably service
Previous breach of these Terms by the customer

If we cancel an order, any payment received will be refunded in full within 5 business days.

5.3 Payment

Payment must be made in full at the time of order. We accept payments through PayFast, including:

Visa and Mastercard credit and debit cards
Instant EFT
SnapScan
Zapper
Other payment methods supported by PayFast at the time of checkout

All payment processing is handled securely by PayFast. Kavrah Scents does not store your full card details.

5.4 Failed Payments

If your payment is declined or fails to process, your order will not be confirmed and we will not dispatch any products. You may retry payment using a different method or contact us for assistance.

6. Delivery

6.1 Delivery Area

We currently deliver within South Africa only. We do not ship to international addresses.

6.2 Delivery Costs

Standard delivery is a flat fee of R89 on orders below R750. Orders of R750 or more qualify for complimentary delivery anywhere in South Africa.

6.3 Delivery Timeframes

Orders are typically processed within 1–2 business days. Once dispatched, delivery generally takes 2–5 business days, depending on your location.

These timeframes are estimates only and are not guaranteed. Once an order has been handed over to our courier partner, delivery times are managed by them.

6.4 Risk and Responsibility

Risk of loss or damage to the products passes to you upon delivery. Once your order has been dispatched and handed over to our courier partner, Kavrah Scents is not responsible for delivery delays, courier-related issues, or losses caused by incorrect delivery information provided at checkout.

It is your responsibility to ensure that the delivery address provided is accurate and complete, and that someone is available to receive the parcel.

6.5 Failed Deliveries

If a delivery fails because of incorrect address details, no available recipient, or refusal to accept the parcel, you may be liable for additional delivery charges if redelivery is requested. Parcels returned to us as undeliverable will be processed in line with our Returns Policy.

8. Intellectual Property

8.1 Our Content

All content on the Kavrah Scents website — including but not limited to text, photographs, logos, branding, product descriptions, page layouts, graphics, and code — is the property of Kavrah Scents or our content suppliers, and is protected by South African and international copyright, trademark, and other intellectual property laws.

8.2 Permitted Use

You may view, browse, and use our website for personal, non-commercial purposes. You may not:

Copy, reproduce, modify, or republish any content from our website without prior written permission
Use our branding, logos, or product imagery for commercial purposes
Scrape, harvest, or mine data from our website using automated tools
Use our website or its content to develop competing products or services
Frame, mirror, or otherwise reproduce our website on another platform

8.3 User-Generated Content

If you submit reviews, comments, photographs, or any other content to our website or social media channels, you grant Kavrah Scents a non-exclusive, royalty-free, worldwide licence to use, reproduce, modify, and display that content for marketing and promotional purposes, including on our website, in advertisements, and across our social media platforms.

You confirm that any content you submit is your own original work and does not infringe the rights of any third party.

9. Acceptable Use

When using our website, you agree not to:

Use the site for any unlawful, fraudulent, or harmful purpose
Attempt to gain unauthorised access to our systems, accounts, or data
Introduce viruses, malware, or any malicious code to the website
Interfere with or disrupt the operation of the website

We reserve the right to suspend or ban any user who violates these conditions, and to pursue legal remedies where appropriate.

10. Disclaimers

10.1 Product Warnings

Kavrah Scents fragrances are intended for external use only. Do not ingest, inhale directly from the bottle, or apply to broken or irritated skin.

If you have known fragrance allergies or particularly sensitive skin, we recommend doing a patch test on your inner wrist before full application. If you experience any adverse reaction, discontinue use immediately and consult a medical professional.

Keep fragrances away from children, eyes, open flames, and direct sunlight. Fragrances are flammable and should be stored and used responsibly.

10.2 Inspired-By Positioning

Kavrah Scents fragrances draw inspiration from celebrated scent profiles. Our products are independently formulated using premium oils sourced from leading houses across France, Switzerland, and beyond, and are not affiliated with, endorsed by, or licensed by the brands or houses that may have inspired their development.

All trademarks and brand names referenced on our website remain the property of their respective owners and are used solely for descriptive purposes.

10.3 Website Availability

We make every effort to keep our website operational, but we do not guarantee uninterrupted access. The website may be temporarily unavailable due to maintenance, technical issues, or factors beyond our control.

10.4 Information Accuracy

While we strive to ensure that all information on our website is accurate and up to date, we do not warrant that descriptions, pricing, or other content is error-free, complete, or current. We reserve the right to correct errors at any time.

11. Limitation of Liability

To the fullest extent permitted by South African law, Kavrah Scents and its directors, employees, and affiliates shall not be liable for:

Any indirect, incidental, consequential, or special damages arising from your use of the website or our products
Any loss of profits, revenue, data, or business opportunities
Any damages arising from courier delays, lost parcels, or third-party service failures once an order has been dispatched
Any allergic reactions or adverse effects from product use, where you have not taken reasonable precautions such as a patch test
Any unauthorised access to your account due to your failure to keep login credentials secure

Our total liability to you in any matter arising from these Terms or your use of our website shall not exceed the amount paid by you for the specific order giving rise to the claim.

Nothing in these Terms limits any rights you have under the Consumer Protection Act 68 of 2008 or any other South African legislation that cannot lawfully be excluded.

12. Indemnification

You agree to indemnify and hold harmless Kavrah Scents, its directors, employees, and affiliates from any claims, losses, damages, liabilities, or expenses (including reasonable legal fees) arising from:

Your breach of these Terms
Your misuse of the website or our products
Your violation of any third party's rights
Any false or misleading information you provide to us

Kavrah Scents shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to:

Acts of God, natural disasters, or extreme weather
War, terrorism, civil unrest, or government action
Pandemics or public health emergencies
Strikes, lockouts, or labour disputes
Power outages, internet failures, or telecommunications disruptions
Courier or supplier failures beyond our control

In such circumstances, we will make reasonable efforts to fulfil our obligations as soon as practicable.

We reserve the right to update these Terms at any time. The "Last updated" date at the top of this page will indicate when the most recent revision was made.

19. Entire Agreement

These Terms, together with our Returns & Refunds Policy and Privacy Policy, constitute the entire agreement between you and Kavrah Scents regarding your use of our website and purchase of our products. They supersede any prior agreements or understandings, whether written or verbal.

20. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa.

Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the South African courts. Where applicable, disputes may also be referred to the Consumer Goods and Services Ombud or the National Consumer Commission for resolution.

21. Dispute Resolution

In the event of a dispute, we encourage you to contact us first at info@kavrah.co.za so we can attempt to resolve the matter informally and promptly. We commit to:

Acknowledging your complaint within 2 business days
Providing a substantive response within 14 business days
Working in good faith to find a fair resolution
